4 Emergency Trust Fund; prescribing its uses;
5 defining what constitutes an "agricultural
6 emergency"; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Section 570.191, Florida Statutes, is
11 created to read:
12 570.191 Agricultural Emergency Trust Fund.--There is
13 created in the office of the commissioner the Agricultural
14 Emergency Trust Fund. Funds in the trust fund may be made
15 available upon certification by the commissioner that an
16 agricultural emergency exists and that funds specifically
17 appropriated for the emergency's purpose are exhausted or
18 insufficient to eliminate the agricultural emergency. The term
19 "agricultural emergency" includes, but is not limited to, an
20 unanticipated disease, insect infestation, emergency wildfire
21 situation, insufficiency of federal funds to carry out the
22 state-federal cooperative brucellosis eradication program, or
23 natural disaster that threatens plants, livestock, or forest
24 and wild lands in the state.
25 Section 2. This act shall take effect July 1, 1997.

Creates the Agricultural Emergency Trust Fund in the
30 office of the Commissioner of Agriculture and provides
for its use in defined emergencies for which ordinary
31 fund sources are inadequate.
