  2         An act relating to agriculture; creating s.

  3         570.191, F.S.; creating the Agricultural

  4         Emergency Eradication Trust Fund; prescribing

  5         its uses; defining what constitutes an

  6         "agricultural emergency"; transferring funds

  7         for Fiscal Year 1998-99; providing an effective

  8         date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Section 570.191, Florida Statutes, is

13  created to read:

14         570.191  Agricultural Emergency Eradication Trust

15  Fund.--There is created in the office of the commissioner the

16  Agricultural Emergency Eradication Trust Fund. Funds in the

17  trust fund may be made available upon certification by the

18  commissioner that an agricultural emergency exists and that

19  funds specifically appropriated for the emergency's purpose

20  are exhausted or insufficient to eliminate the agricultural

21  emergency. The term "agricultural emergency" means an animal

22  or plant disease, insect infestation, or plant or pest

23  endangering or threatening the horticultural, aquacultural, or

24  agricultural interests in this state.

25         Section 2.  For Fiscal Year 1998-99, up to $10 million

26  collected in the Agricultural Emergency Eradication Trust Fund

27  is hereby transferred to the Plant Industry Trust Fund for the

28  purposes of carrying out any existing or future declared

29  agricultural emergencies.

30         Section 3.  This act shall take effect July 1 of the

31  year in which enacted.
