1 A bill to be entitled
2 An act relating to food products; amending s.
3 500.04, F.S.; prohibiting the sale, the
4 delivery for sale, or the offering for sale of
5 repackaged or rewrapped raw meat, fish, or
6 poultry that does not display specified
7 labeling; reenacting s. 500.177(1), F.S.,
8 relating to the penalty for violation of s.
9 500.04, F.S., to incorporate the amendment to
10 s. 500.04, F.S., in a reference thereto;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Subsection (12) is added to section 500.04,
16 Florida Statutes, to read:
17 500.04 Prohibited acts.--The following acts and the
18 causing thereof within the state are prohibited:
19 (12) The sale, delivery for sale, or offering for sale
20 of any repackaged or rewrapped raw meat, fish, or poultry that
21 does not display a label that clearly states the "use by"
22 date, the "sell by" date, the quality state/inventory control,
23 or similar date that appeared on the package originally
24 offered for retail sale.
25 Section 2. For the purpose of incorporating the
26 amendment to section 500.04, Florida Statutes, in references
27 thereto, subsection (1) of section 500.177, Florida Statutes,
28 is reenacted to read:
29 500.177 Penalty for violation of s. 500.04;
30 dissemination of false advertisement.--

1 (1) Any person who violates any provision of s. 500.04
2 is guilty of a misdemeanor of the second degree, punishable as
3 provided in s. 775.082 or s. 775.083; but, if the violation is
4 committed after a conviction of such person under this section
5 has become final, such person is guilty of a misdemeanor of
6 the first degree, punishable as provided in s. 775.082 or s.
7 775.083.
8 Section 3. This act shall take effect October 1 of the
9 year in which enacted.

Prohibits the sale, delivery for sale, or offering for
14 sale of any repackaged or rewrapped raw meat, fish, or
poultry that does not display a label that clearly states
15 the "use by" date, the "sell by" date, the quality
state/inventory control, or similar date that appeared on
16 the package originally offered for retail sale. Provides
a second-degree misdemeanor penalty for violation.
