  1                      A bill to be entitled

  2         An act relating to governmental purchasing;

  3         amending ss. 235.31, 287.093, F.S.; authorizing

  4         certain local governmental entities to

  5         implement certain small-business-enterprise

  6         programs; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Paragraph (d) is added to subsection (1) of

11  section 235.31, Florida Statutes, to read:

12         235.31  Advertising and awarding contracts;

13  prequalification of contractor.--

14         (1)

15         (d)  A county, municipality, community college, or

16  district school board may, in its sole discretion, implement a

17  small-business-enterprise program that includes designating

18  construction project contracts for competitive bidding by

19  small business enterprises, when feasible.

20         Section 2.  Section 287.093, Florida Statutes, is

21  amended to read:

22         287.093  Minority business enterprises; procurement of

23  personal property and services from funds set aside for such

24  purpose.--

25         (1)  Any county, municipality, community college, or

26  district school board may set aside up to 10 percent or more

27  of the total amount of funds allocated for the procurement of

28  personal property and services for the purpose of entering

29  into contracts with minority business enterprises.  Such

30  contracts shall be competitively bid only among minority

31  business enterprises.  The set-aside shall be used to redress

  1  present effects of past discriminatory practices and shall be

  2  subject to periodic reassessment to account for changing needs

  3  and circumstances.

  4         (2)  A county, municipality, community college, or

  5  district school board may, in its sole discretion, implement a

  6  small-business-enterprise program that includes designating

  7  contracts for competitive bidding by small business

  8  enterprises, when feasible.

  9         Section 3.  This act shall take effect July 1, 1998.
