2 An act relating to the North Lauderdale Water
3 Control District, Broward County; amending
4 chapter 63-661, Laws of Florida, as amended;
5 reducing the number of members of the Board of
6 Supervisors of the North Lauderdale Water
7 Control District from a board of seven members
8 to a board of five members to be composed of
9 sitting members of the City Council of the City
10 of North Lauderdale within 30 days after this
11 act becomes a law; providing intent with
12 respect to the election of supervisors;
13 providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Section 4 of chapter 63-661, Laws of
18 Florida, as amended by chapters 82-273 and 94-428, Laws of
19 Florida, is amended to read:
20 Section 4. BOARD OF SUPERVISORS. ELECTION.
21 APPOINTMENT OF THE FIRST BOARD. ORGANIZATION. POWERS. DUTIES
22 AND TERMS OF OFFICE. There is hereby created a Board of
23 Supervisors of North Lauderdale Water Control District which
24 shall be the governing body of said district. The members of
25 the board of supervisors of said district shall be composed of
26 five members, who shall be the five sitting members of the
27 City Council of the City of North Lauderdale. The city
28 council shall assume all of the duties, functions, and
29 responsibilities under this act of the supervisors of the
30 district, within 30 days after this act becomes a law.

1 The term of office of each member of the board of
2 supervisors shall be coincidental with that member's term of
3 office as a member of the city council. The members shall
4 assume full duties as a member of the board of supervisors
5 once he or she takes the oath of office, as a member of the
6 city council. seven (7) members, two (2) of whom shall be
7 appointed every 2 years by the City Council of the City of
8 North Lauderdale for terms of 2 years. The City Council of
9 the City of North Lauderdale may either appoint the two (2)
10 members to the Board of Supervisors from among its members,
11 or, alternatively, the City Council may appoint a citizen and
12 resident of North Lauderdale as their designee to serve the
13 2-year term described herein.
14 The initial two (2) Supervisors appointed by the City
15 Council of the City of North Lauderdale shall be appointed
16 within 30 days after this act becomes a law, for terms of
17 office of 2 years. Appointments shall thereafter be made for
18 2-year terms. Terms of office for the existing members of the
19 board of supervisors shall be concurrent with four (4) years
20 the length of time the council member is in office. the
21 present term of the members of the Board of Supervisors or
22 their successors in the event of a vacancy or the election of
23 a new member prior to the effective date of this act, to wit:
24 September 1, 1982, shall be extended and serve until the first
25 business day of June, 1984, at which time an election will be
26 held for three (3) seats on said board; two (2) new members
27 will be elected by the landowners within ninety (90) days of
28 the effective date of this amended act to serve until June,
29 1986; thereafter, elections for said number of seats on the
30 Board of Supervisors shall be held every two (2) years in the

1 month of June at the annual landowners meeting to elect
2 supervisors whose terms have expired.
3 An annual meeting of the board of supervisors shall be
4 held during the first week weekday of June and otherwise in
5 accordance with this act. At said meeting, the landowners
6 shall vote for the Supervisor who is to be elected in that
7 year. Each and every acre of land or any portion thereof in
8 the District shall represent one (1) share and each owner
9 shall be entitled to one vote by person or by written proxy
10 for every acre or any portion thereof of land owned by him in
11 the District.
12 All vacancies on said Board shall be filled by the
13 choice of the remaining Supervisors who shall serve until the
14 next elective annual meeting wherein the landowners, in
15 accordance herewith, shall elect Supervisors to said Board.
16 Section 5. Section 5 of chapter 63-661, Laws of
17 Florida, as amended, entitled "Meetings of Landowners. Method
18 of Election of Supervisors." is hereby repealed to the extent,
19 and only to the extent, that no election of supervisors shall
20 be conducted, but that all other matters affecting meetings of
21 the board of supervisors shall occur as otherwise set forth in
22 this section.
23 Section 2. This act shall take effect upon becoming a
24 law.
