  1                      A bill to be entitled

  2         An act relating to public officials; making it

  3         a criminal offense for a public official to

  4         accept specified loans; providing an effective

  5         date.

  7  Be It Enacted by the Legislature of the State of Florida:

  9         Section 1.  (1) A public official may not solicit or

10  accept a loan of money from any person, other than a lending

11  institution, doing business with the state.

12         (2) As used in this section, the term:

13         (a) "Public official" means any public officer as

14  defined in section 112.313(1), Florida Statutes, and any

15  employee or appointed state officer as defined in section

16  112.313(9)(a), Florida Statutes.

17         (b) "Lending institution" means any bank or trust

18  company, mortgage banker, savings bank, credit union, national

19  banking association, savings and loan association, building

20  and loan association, insurance company, or other financial

21  institution authorized to transact business in this state.

22         (3) Any public official who knowingly violates this

23  section commits a misdemeanor of the first degree, punishable

24  as provided in section 775.082, Florida Statutes, or section

25  775.083, Florida Statutes.

26         Section 2.  This act shall take effect July 1, 1998.
