14         On page 2, line 15, through page 3, line 7,

15  remove from the bill:  all of said lines

17  and insert in lieu thereof:

18         (8)  The Legislature declares that the Kissimmee River,

19  Florida Project as identified in the Project Cooperation

20  Agreement between the Department of the Army and the South

21  Florida Water Management District, dated March 22, 1994, and

22  the C-111 Project as identified in the Central and Southern

23  Florida Flood Control Project Real Estate Design Memorandum

24  Canal 111, South Dade County, Florida are in the public

25  interest, for a public purpose and are necessary for the

26  public health and welfare. Through July 1, 2000 the Governing

27  board of the District is empowered and authorized to acquire

28  fee title or easement by eminent domain for the limited

29  purpose of implementing the Kissimmee River, Florida Project

30  and the C-111 Project, more fully described above, and the

31  acquisition of real property, including by eminent domain, for

 1  these objectives constitutes a public purpose for which it is

 2  in the public interest to expend public funds.

 3         (9)  Through July 1, 2000, the South Florida Water

 4  Management District may disburse state or district funds to

 5  any agency or department of the federal government in any

 6  agreement or arrangement to take property or any interest

 7  therein by eminent domain, pursuant to federal law, unless

 8  such arrangement diminishes or deprives a person or entity of

 9  any right, privilege, or compensation that they would

10  otherwise have if the property or interest was taken by

11  eminent domain under Florida law. this subsection shall not

12  apply to federal grant funds received by the state or

13  district.
