  1                      A bill to be entitled

  2         An act relating to child support; amending s.

  3         61.13, F.S.; providing that the obligation of

  4         child support shall be retroactive to the date

  5         of legal separation; providing for credits;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Subsection (9) is added to section 61.13,

11  Florida Statutes, 1996 Supplement, to read:

12         61.13  Custody and support of children; visitation

13  rights; power of court in making orders.--

14         (9)  The obligation of child support shall be

15  retroactive to the date of legal separation of parents in

16  dissolution cases with credit given for voluntary payments

17  made to the custodial parent and third parties for the benefit

18  of the child or children.

19         Section 2.  This act shall take effect upon becoming a

20  law.
