14         Senate Amendment (with title amendment) 

15         On page 3, between lines 1 and 2,

16

17  insert:

18         Section 3.  Subsections (5) and (6) are added to

19  section 322.142, Florida Statutes, to read:

20         322.142  Color photographic or digital imaged

21  licenses.--

22         (5)  Notwithstanding any other provisions of law, the

23  department may sell copies of photographs, electronically

24  stored photographs, or digitized images and other driver's

25  license and state identification card information on file,

26  which are recorded and maintained as required, if such items

27  are to be used solely for the prevention of fraud, including,

28  but not limited to, use in mechanism intended to prevent the

29  fraudulent use of credit cards, debit cards, or checks or

30  fraud in other forms of financial transactions. The use of

31  such photographs, electronically stored photographs, or

 1  digitized images obtained pursuant to this subsection is

 2  limited to the verification of the identity of the holder of

 3  an account, other form of identification, or other similar

 4  uses and may not be used for any other purpose.

 5         (6)  Notwithstanding any other provisions of law, the

 6  department may sell copies of photographs, electronically

 7  stored photographs, or digitized images maintained by the

 8  department as required, upon receipt of the following from an

 9  applicant:

10         (a)  Proof of the identity of the applicant;

11         (b)  A declaration, in such form as is required by the

12  department, describing how the applicant will use such

13  photographs, electronically stored photographs, or digitized

14  images for the prevention of fraud; and

15         (c)  Payment of a fee for the photographs,

16  electronically stored photographs, or digitized images. The

17  department shall establish a fee for providing copies of such

18  photographs, electronically stored photographs, or digitized

19  images and all fees collected pursuant to this subsection

20  shall be used to defray the costs of the department in

21  providing such copies to an applicant.
