1 A bill to be entitled
2 An act relating to the Beverage Law; amending
3 s. 561.67, F.S.; providing that it is unlawful
4 for any licensed vendor to obstruct or hinder a
5 reclamation by a distributor of beverages not
6 paid for by a licensed vendor; providing for an
7 exemption from certain criminal trespass
8 provisions and an exemption from liability for
9 civil trespass; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsections (3) and (4) of section 561.67,
14 Florida Statutes, 1996 Supplement, are renumbered as
15 subsections (4) and (5), respectively, and a new subsection
16 (3) is added to said section to read:
17 561.67 Reclamation by distributor of beverages not
18 paid for by licensed vendors.--
19 (3) It is unlawful for any licensed vendor to obstruct
20 or hinder a reclamation by an authorized distributor under
21 this section. Any authorized distributor executing a
22 reclamation shall be exempt from the provisions of s. 810.08
23 and shall not be liable for civil trespass.
24 Section 2. This act shall take effect October 1, 1997.

27 HOUSE SUMMARY

Revises a provision of law relating to the reclamation by
29 the distributor of beverages not paid for by licensed
vendors to provide that it is unlawful for any licensed
30 vendor to obstruct or hinder a lawful reclamation.
Provides that an authorized distributor executing a
31 reclamation shall not be liable for civil or criminal
trespass.
