8 review and repeal; providing a finding of
9 public necessity; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Paragraph (z) of subsection (3) of section
14 119.07, Florida Statutes, is amended to read:
15 119.07 Inspection, examination, and duplication of
16 records; exemptions.--
17 (3)
18 (z) Bank account numbers or debit, charge, or credit
19 card numbers in the possession of given to an agency for any
20 the purpose, including of payment of any fee or debt owing,
21 are confidential and exempt from subsection (1) and s. 24(a),
22 Art. I of the State Constitution. However, such numbers may
23 be given to any governmental entity in order for that
24 governmental entity to carry out its duties and
25 responsibilities or used by an agency, as needed, in any
26 administrative or judicial proceeding, provided such numbers
27 are kept confidential and exempt, unless otherwise ordered by
28 the court. This paragraph is subject to the Open Government
29 Sunset Review Act of 1995 in accordance with s. 119.15, and
30 shall stand repealed on October 2, 2003 2001, unless reviewed
31 and saved from repeal through reenactment by the Legislature.

1 Section 2. The Legislature finds that it is a public
2 necessity that bank account numbers or debit, charge, or
3 credit card numbers in the possession of an agency be held
4 confidential and exempt from public disclosure because
5 revealing such information could create the opportunity for
6 fraud and impede technological innovation. This exemption
7 will create a secure environment in which agencies, and their
8 employees, and persons doing business with government, can
9 meet their respective financial obligations.
10 Section 3. This act shall take effect upon becoming a
11 law.
