18         Section 3.  Subsections (1) and (3) of section

19  624.3161, Florida Statutes, are amended to read:

20         624.3161  Market conduct examinations.--

21         (1)  As often as it deems necessary, and not less

22  frequently than each 5 years, the department shall examine

23  each licensed rating organization, each advisory organization,

24  each group, association, or other organization of insurers

25  which engages in joint underwriting or joint reinsurance, and

26  each authorized insurer transacting in this state any class of

27  insurance to which the provisions of part I of chapter 627 are

28  applicable.  The examination shall be for the purpose of

29  ascertaining compliance by the person examined with the

30  applicable provisions of chapters 624, 626, 627, and 635.

31         (3)  Upon agreement between the department and the

  1  insurer, Such examination may be conducted by an independent

  2  professional examiner under contract to the department, in

  3  which case payment shall be made directly to the contracted

  4  examiner by the insurer examined in accordance with the rates

  5  and terms agreed to by the department, the insurer, and the

  6  examiner.
