  1                      A bill to be entitled

  2         An act relating to loaned, rented, or leased

  3         motor vehicles; creating s. 768.092, F.S.;

  4         limiting liability for certain damages and

  5         injuries; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Section 768.092, Florida Statutes, is

10  created to read:

11         768.092  Limits on Liability for Loaned, Rented, or

12  Leased motor vehicles.--

13         (1)  Notwithstanding any other provision of law, a

14  motor vehicle rental business that rents or leases a vehicle

15  for a term of up to 1 year shall be liable for the actions of

16  the person operating the vehicle only up to $1 million per

17  incident without a showing of negligence or intentional

18  misconduct on the part of the motor vehicle owner.

19         (2)  Notwithstanding any other provision of law, an

20  owner of a motor vehicle who lends the vehicle to another

21  person shall be liable for the actions of the person operating

22  the vehicle only up to $100,000 per person with a maximum of

23  $300,000 per accident without a showing of negligence or

24  intentional misconduct on the part of the motor vehicle owner.

25         Section 2.  This act shall take effect upon becoming a

26  law.

30    Limits the liability of a motor vehicle rental business
      and the owner of a motor vehicle for injury to persons
31    caused by the actions of the operator of a rental or
      loaned motor vehicle.
