18         Section 28.  Paragraph (c) of subsection (10) of

19  section 287.055, Florida Statutes, 1996 Supplement, is amended

20  to read:

21         287.055  Acquisition of professional architectural,

22  engineering, landscape architectural, or surveying and mapping

23  services; definitions; procedures; contingent fees prohibited;

24  penalties.--

25         (10)  APPLICABILITY TO DESIGN-BUILD CONTRACTS.--

26         (c)  Except as otherwise provided in s. 240.209(3) or

27  s. 337.11(7), the Department of Management Services shall

28  adopt rules for the award of design-build contracts to be

29  followed by state agencies.  Each other agency must adopt

30  rules or ordinances for the award of design-build contracts.

31  For Municipalities, political subdivisions, school districts,

  1  and school boards shall award design-build contracts by the

  2  use of a competitive proposal selection process as described

  3  in this subsection, or by the use of a qualifications-based

  4  selection process pursuant to subsections (3), (4), and (5).

  5  During the qualifications-based selection of the design-build

  6  firm, the procuring agency may employ or retain a licensed

  7  design professional appropriate to the project to serve as the

  8  agency's representative. Procedures for the use of a

  9  competitive proposal selection process, such procedures must

10  include as a minimum the following:

11         1.  The preparation of a design criteria package for

12  the design and construction of the public construction

13  project.

14         2.  The qualification and selection of no fewer than

15  three design-build firms as the most qualified, based on the

16  qualifications, availability, and past work of the firms,

17  including the partners or members thereof.

18         3.  The criteria, procedures, and standards for the

19  evaluation of design-build contract proposals or bids, based

20  on price, technical, and design aspects of the public

21  construction project, weighted for the project.

22         4.  The solicitation of competitive proposals, pursuant

23  to a design criteria package, from those qualified

24  design-build firms and the evaluation of the responses or bids

25  submitted by those firms based on the evaluation criteria and

26  procedures established prior to the solicitation of

27  competitive proposals.

28         5.  For consultation with the employed or retained

29  design criteria professional concerning the evaluation of the

30  responses or bids submitted by the design-build firms, the

31  supervision or approval by the agency of the detailed working

  1  drawings of the project; and for evaluation of the compliance

  2  of the project construction with the design criteria package

  3  by the design criteria professional.

  4         6.  In the case of public emergencies, for the agency

  5  head to declare an emergency and authorize negotiations with

  6  the best qualified design-build firm available at that time.

16         amending s. 287.055, F.S.; providing that

17         municipalities, political subdivisions, school

18         districts, and school boards, as an alternative

19         to awarding design-build contracts using a

20         competitive proposal selection process as

21         described in said section, may award such

22         contracts using a qualifications-based

23         selection process pursuant to standards for

24         competitive selection and competitive

25         negotiation for entering into a contract for a

26         guaranteed maximum price and completion date;
