13         Amendment to Amendment (925915) 

14         On page 12, between lines 13 and 14, of the amendment

15

16  Insert:

17         (k)  Notwithstanding the provisions of paragraph (j) to

18  the contrary, if a substance abuse services provider fails to

19  meet 80 percent of any of its performance standards

20  established in the contract, the department must, in lieu of

21  renewal at the end of the contract period, competitively

22  procure the contract for substance abuse services, pursuant to

23  paragraphs (a) and (b). The department must cancel the

24  contract with a substance abuse provider that fails to meet at

25  least 50 percent of a performance standard. The department may

26  not enter into a new contract with that same provider for the

27  services for which the contract was previously canceled for a

28  period of at least 12 months after the date of cancellation.

29  The provisions of this paragraph shall not apply in a service

30  area in which there is no alternative substance abuse services

31  provider.
