1 A bill to be entitled
2 An act relating to Rainbow Lake Estates, Marion
3 and Levy Counties; amending chapter 69-1298,
4 Laws of Florida; authorizing the levy and
5 assessment of special assessments to fund
6 municipal services; providing an effective
7 date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 4 of chapter 69-1298, Laws of
12 Florida, is amended to read:
13 Section 4. The district board of said district is
14 authorized and empowered:
15 1. To make rules and regulations for its own
16 government and proceedings and to adopt an official seal for
17 the district.;
18 2. To employ engineers, attorneys, accountants,
19 financial or other experts and such other agents and employees
20 as said district board may require or deem necessary to
21 effectuate the purposes of this law, or to contract for any of
22 such services.;
23 3. To provide the following municipal services within
24 said district:
25 A. Road maintenance and lighting.
26 B. Maintenance and operation of all public lands and
27 all public civic and recreational facilities.
28 C. To provide law enforcement.
29 D. To provide fire protection.
30 E. To exercise zoning powers consistent with and for
31 the enforcement of existing deed restrictions and covenants

1 contained in or incorporated in conveyances of lots in the
2 subdivision of Rainbow Lakes Estates.
3 F. To provide for and regulate and control the
4 furnishing of water, gas, electric, telephone, and other
5 public utility services within said district, including the
6 franchising and taxing of such services.
7 4. To acquire in the name of the district by purchase,
8 gift, or the exercise of the right of eminent domain, such
9 lands and rights and interest therein, including lands under
10 water and riparian rights and to acquire such personal
11 property as it may deem necessary in connection with the
12 furnishing of services authorized by this law and to hold and
13 dispose of all real and personal property under its control;
14 provided, however, nothing herein contained shall authorize
15 the power of eminent domain to be exercised beyond the limits
16 of the district.
17 5. To restrain, enjoin, or otherwise prevent the
18 violation of this law or of any resolution, rule, or
19 regulation adopted pursuant to the powers granted by this
20 law.;
21 6. To join with any other district or districts,
22 cities, towns, counties, or other political subdivisions,
23 public agencies or authorities in the exercise of common
24 powers.;
25 7. To levy a special ad valorem maintenance tax upon
26 all taxable real and personal property within said district
27 not to exceed three (3) mills during any one year. Such
28 special maintenance tax shall be levied and collected in the
29 manner provided for the levy and collection of county ad
30 valorem taxes. The district board shall certify each year to
31 the tax collectors of Marion county and Levy county,

1 respectively, the millage levied as such special maintenance
2 tax and said tax assessors shall be ex-officio tax assessors
3 for the district, and such taxes shall be levied and collected
4 in the same manner as other general county taxes. Taxes
5 collected shall be remitted by said tax assessors to the clerk
6 of the circuit court for Marion county, Florida, as ex-officio
7 clerk and treasurer of said district.
8 (8) To levy and assess special assessments to fund
9 municipal services within said district. The district board
10 shall certify each year to the tax collectors of Marion County
11 and Levy County, respectively, a non-ad valorem assessment
12 roll, and said tax collectors shall be ex officio tax
13 collectors for the district, and such special assessments
14 shall be levied and collected pursuant to general law.
15 Special assessments collected shall be remitted by said tax
16 collectors to the clerk of the circuit court for Marion County
17 as ex officio clerk and treasurer of said district.
18 Section 2. This act shall take effect October 1, 1997.
