11  Senator Latvala moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 31, between lines 15 and 16,

15

16  insert:

17         Section 12.  Subsection (1) of section 380.504, Florida

18  Statutes, is amended to read:

19         380.504  Florida Communities Trust; creation;

20  membership; expenses.--

21         (1)  There is created within the Department of

22  Community Affairs a nonregulatory state agency and

23  instrumentality, which shall be a public body corporate and

24  politic, known as the "Florida Communities Trust." The

25  governing body of the trust shall consist of:

26         (a)  The Secretary of Community Affairs, and the

27  Secretary of Environmental Protection, and the director of the

28  Division of Historical Resources in the Department of State;

29  and

30         (b)  Three public members whom the Governor shall

31  appoint subject to Senate confirmation.

 2  The Governor shall appoint a former elected official of a

 3  local government, a representative of a nonprofit organization

 4  as defined in this part, and a representative of the

 5  development industry. The Secretary of Community Affairs may

 6  designate his or her assistant secretary or the director of

 7  the Division of Resource Planning and Management to serve in

 8  his or her absence. The Secretary of Environmental Protection

 9  may appoint his or her assistant executive director, the

10  deputy assistant director for Land Resources, the director of

11  the Division of State Lands, or the director of the Division

12  of Recreation and Parks to serve in his or her absence. The

13  Secretary of Community Affairs shall be the chair of the

14  governing body of the trust. The Governor shall make his or

15  her appointments upon the expiration of any current terms or

16  within 60 days after the effective date of the resignation of

17  any member.
