2 An act relating to the State Lands Management
3 Trust Fund; creating s. 253.026, F.S.; creating
4 the State Lands Management Trust Fund;
5 providing its purposes; providing an effective
6 date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Section 253.026, Florida Statutes, is
11 created to read:
12 253.026 State Lands Management Trust Fund; purpose.--
13 (1) The Legislature recognizes that the state's land
14 acquisition programs have resulted in an increasing amount of
15 conservation and recreation lands and other lands having
16 important cultural, restoration, and natural resource values
17 being placed in the ownership and control of the state and
18 water management districts. The Legislature recognizes the
19 need to provide financial resources for the management and use
20 of these public lands and to provide compensation to
21 qualifying local governments for actual ad valorem tax losses
22 as a result of the state's land acquisition programs.
23 (2)(a) The State Lands Management Trust Fund is
24 established within the Department of Environmental Protection.
25 Beginning July 1, 1998, the fund shall be credited with
26 proceeds from the following excise taxes:
27 1. The excise tax on documents as provided in s.
28 201.15(4) and (5); and
29 2. The excise tax on the severance of phosphate rock
30 as provided in s. 211.3103(2) or (3).

1 (b) Except for the amounts required to make any debt
2 service payments on bonds issued prior to July 1, 1998, under
3 s. 373.584, which have a priority, the fund must be used
4 exclusively for management, maintenance, and capital
5 improvements on lands acquired for conservation, open spaces,
6 recreation, cultural, or ecosystem restoration purposes; for
7 beach renourishment and restoration activities; for water
8 resource development and water supply development activities;
9 and for payments in lieu of taxes to qualifying local
10 governments under s. 259.032(12) and s. 373.59(14).
11 Section 2. This act shall take effect on the effective
12 date of Senate Bill , but it shall not take effect unless
13 it is enacted by a three-fifths vote of the membership of each
14 house of the Legislature and unless SB , 1998 Regular
15 Session, becomes a law.

18 SENATE SUMMARY
19 Creates the State Lands Management Trust Fund to be
administered by the Department of Environmental
