19 Supplement, is amended to read:
20 383.0113 Commission on Responsible Fatherhood;
21 creation; membership; powers and duties.--There is created the
22 Commission on Responsible Fatherhood in the Department of
23 Children and Family Health and Rehabilitative Services.
24 (1) The commission shall consist of not more than 25
25 members, as provided in this subsection and subsection (2)
26 follows:
27 (a) Twelve Seven members to be appointed by the
28 Governor. The appointments shall represent the various
29 organizations and individuals who have expertise in promoting
30 successful strategies for involving responsible fathers in the
31 lives of their children.

1 (b) The executive director of the Florida Center for
2 Children and Youth or the director's designee.
3 (c) The executive director of the Florida Coalition
4 Against Domestic Violence or the director's designee.
5 (b)(d) A judge, to be appointed by the Chief Justice
6 of the Supreme Court to serve a 2-year term.
7 (c)(e) A representative of Healthy Start, to be chosen
8 by the Florida Association of Healthy Start Coalitions.
9 (d)(f) Two members of the House of Representatives
10 from different political parties, to be appointed by the
11 Speaker.
12 (e)(g) Two members of the Senate from different
13 political parties, to be appointed by the President.
14 (h) A representative from the Florida Association of
15 Deans and Directors of Schools and departments of social work
16 from Florida colleges and universities.
17 (i) A representative of the Florida chapter of the
18 National Congress for Fathers and Children.
19 (j) A representative of Men Against Destruction,
20 Defending Against Drugs and Social Disorder (MAD DADS).
21 (k) A representative of the Family Law Section of The
22 Florida Bar Association.
23 (l) A representative of the American Association of
24 Retired Persons.
25 (m) A representative of the Florida Chamber of
26 Commerce.
27 (n) A representative from the Florida Family Council.
28 (o) Three additional members to be appointed by the
29 other members of the commission based on specific needs.
30 (2) The following representatives of state agencies
31 shall serve on the commission Technical assistance will be

1 provided to the commission by the following:
2 (a) The Secretary of Children and Family Health and
3 Rehabilitative Services, or the secretary's designee.
4 (b) The Commissioner of Education, or the
5 commissioner's designee.
6 (c) The Secretary of Labor and Employment Security, or
7 the secretary's designee.
8 (d) The executive director of the Department of
9 Revenue, or the director's designee. The designee shall have
10 experience with child support enforcement programs.
11 (e) The Secretary of Health, or the secretary's
12 designee. The designee must have experience with
13 community-based prenatal and infant health care coalitions as
14 established under s. 383.216. A representative of The Parent
15 Network of Florida.
16 (f) The Secretary of Corrections, or the secretary's
17 designee. A representative of the Florida Network of Youth and
18 Family Services.
19 (g) The secretary of the Department of Juvenile
20 Justice or the secretary's designee.

22 Per diem and travel expenses for the individuals providing
23 technical assistance is to be provided from the budgets of
24 those agencies.
25 (3) All members of the commission, other than the
26 Governor's appointments and the commission's appointments,
27 must be appointed by July 1 of each year within 30 days after
28 this section, s. 383.0112, and s. 383.0114 become law. The
29 appointments of the Governor shall be made 30 days after the
30 other appointments, to allow for the composition of the
31 commission to be broadly reflective of the public. Any member

1 may be reappointed. The chairperson and vice chairperson of
2 the commission shall be appointed by the Governor and shall
3 serve for 2 years. The commission is encouraged to appoint
4 subcommittees, including regional subcommittees, that include
5 citizens who are knowledgeable in a subject area but who are
6 not members of the commission and who may not vote on the
7 final report and recommendations of the commission, but may
8 submit reports and recommendations for review by the
9 commission and may be invited to testify to the commission by
10 a member of the commission.
11 (4) Members appointed by the Governor shall be
12 appointed for 2-year terms. However, initial terms of less
13 than 2 years may be utilized to provide for staggered term for
14 the numbers of the commission.
15 (5) Terms of appointees who are serving on the
16 commission on the effective date of this act shall expire June
17 30, 1998.
18 (6)(4) The commission shall hold its first meeting
19 within 30 days after the appointments, except the Governor's
20 and the commission's appointments, are made. Members of the
21 commission shall serve without compensation but shall be
22 allowed per diem and travel expenses, as provided in s.
23 112.061. Per diem and travel expenses of members of the
24 commission employed by the State of Florida are to be provided
25 from the budgets of those employing agencies. Members of the
26 commission who serve as members of the Legislature are to be
27 reimbursed from the legislative budget.
28 (7)(5) The commission shall meet as the resources of
29 the commission allow.
30 (8)(6) Subject to the availability of funds, the
31 department of Health and Rehabilitative Services is directed

1 to contract with one or more corporations, agencies,
2 individuals, or governmental entities to accomplish the goals
3 of s. 383.0112 and this section. The department of Health and
4 Rehabilitative Services must ensure that the corporations,
5 agencies, individuals, or governmental entities, either
6 separately or together, are able to provide staff support
7 services and must have the research ability to carry out the
8 purposes and responsibilities of the commission.
9 (9)(7) The commission shall have the authority to
10 apply for grants and accept private contributions.
11 (10)(8) The commission is assigned to the department
12 of Health and Rehabilitative Services for administrative and
13 fiscal accountability purposes, but it shall otherwise
14 function independently of the control, supervision, and
15 direction of the department.
16 (11)(9) The Governor may remove any member of the
17 commission for cause.
18 (12)(10) The commission shall develop a budget
19 pursuant to the provisions of chapter 216. The budget is not
20 subject to change by the department staff after it has been
21 approved by the commission, but it shall be transmitted to the
22 Governor along with the budget of the department.
