  1                      A bill to be entitled

  2         An act relating to firearms sales; creating s.

  3         790.0657, F.S.; applying the laws relating to

  4         the sale, transfer, delivery, and purchase of

  5         firearms to transactions occurring at gun

  6         shows, exhibitions, and flea markets; defining

  7         terms; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 790.0657, Florida Statutes, is

12  created to read:

13         790.0657  Sale and delivery of firearms at gun shows,

14  exhibitions and flea markets.--

15         (1)  Laws relating to the sale, transfer, delivery,

16  furnishing, and purchase of firearms apply to such

17  transactions occurring at gun shows, exhibitions, and flea

18  markets and on their premises.

19         (2)  Any person engaged in the business of selling or

20  dealing in firearms at gun shows, exhibitions, or flea markets

21  or on their premises must be a licensed firearms dealer.

22         (3)  As used in this section, the term:

23         (a)  "Dealer" means a person engaged in the business of

24  selling firearms at wholesale or retail or a pawnbroker.

25         (b)  "Licensed firearms dealer" means any dealer who is

26  licensed to sell firearms under the provisions of federal law.

27         (c)  "Pawnbroker" means any person whose business or

28  occupation includes the taking or receiving, by way of pledge

29  or pawn, of any firearm as security for the payment or

30  repayment of money.

  1         (d)  "Engaged in the business" means a person who

  2  devotes time, attention, and labor to dealing in firearms as a

  3  regular course of trade or business with the principal

  4  objective of livelihood and profit through the repetitive

  5  purchase and resale of firearms. The term does not include a

  6  person who makes occasional sales, exchanges, or purchases of

  7  firearms for the enhancement of a personal collection or for a

  8  hobby, or makes an occasional sale of all or part of a

  9  personal collection of firearms.

10         Section 2.  This act shall take effect upon becoming a

11  law.
