19 Section 4. Subsection (2) of section 236.25, Florida
20 Statutes, is amended and subsection (5) is added to said
21 section to read:
22 236.25 District school tax.--
23 (2)(a) In addition to the maximum millage levy as
24 provided in subsection (1), each school board may levy not
25 more than 2.5 2 mills against the taxable value for school
26 purposes to fund:
27 1.(a) New construction and remodeling projects, as set
28 forth in s. 235.435(3)(b), without regard to the
29 prioritization in that section, sites and site improvement or
30 expansion to new sites, existing sites, auxiliary facilities,
31 athletic facilities, or ancillary facilities.

1 2.(b) Maintenance, renovation, and repair of existing
2 school plants or of leased facilities to correct deficiencies
3 pursuant to s. 235.056(2).
4 3.(c) The purchase, lease-purchase, or lease of school
5 buses; drivers' education vehicles; motor vehicles used for
6 the maintenance or operation of plants and equipment; security
7 vehicles; or vehicles used in storing or distributing
8 materials and equipment.
9 4.(d) The purchase, lease-purchase, or lease of new
10 and replacement equipment.
11 5.(e) Payments for educational facilities and sites
12 due under a lease-purchase agreement entered into by a school
13 board pursuant to s. 230.23(9)(b)5. or s. 235.056(2), not
14 exceeding, in the aggregate, an amount equal to 75 percent
15 one-half of the proceeds from the millage levied by a school
16 board pursuant to this subsection.
17 6.(f) Payment of loans approved pursuant to ss.
18 237.161 and 237.162.
19 7.(g) Payment of costs directly related to complying
20 with state and federal environmental statutes and regulations
21 governing school facilities.
22 8.(h) Payment of costs of leasing relocatable
23 educational facilities and of renting or leasing educational
24 facilities and sites pursuant to s. 235.056(2).
25 (b)1. Effective July 1, 1997, the millage rate levied
26 pursuant to this subsection may exceed the rate levied in
27 1996-1997 only for the purpose of providing new classrooms for
28 students. For purposes of this subsection, "new classrooms"
29 are defined as instructional space for students in
30 prekindergarten through grade 12 that is new construction of a
31 building or a unit of a building in which the work is new or

1 an entirely new addition connected to an existing building. If
2 a complete new school is being constructed, "new classrooms"
3 includes all of the standard space required at the school
4 site. The classrooms may be acquired by lease, lease-purchase,
5 contract, or purchase and may include new relocatable
6 classrooms. The limitation to "new classrooms" does not apply
7 to the proceeds from the first 2.0 of the 2.5 mills.
8 2. Each district school board that levied millage
9 pursuant to paragraph (a) prior to July 1, 1997, and
10 transferred funds from the capital improvement budget to the
11 operating budget shall review the expenditures of the
12 transferred funds and shall develop a plan for reducing the
13 amount of the proceeds from the capital improvement millage
14 that is transferred to the operating budget. The amount of the
15 reduction shall be not less than 10 percent per year.
16 Reductions made prior to July 1, 1997, may be credited toward
17 this requirement. If, in any year, a school board finds that a
18 reduction of 10 percent will cause an unreasonable adverse
19 impact on the district's operations, the school board may
20 request the Commissioner of Education to review its financial
21 status and, if the commissioner concurs, the commissioner may
22 waive all or part of the reduction for that year.

24 Violations of these expenditure provisions of this subsection
25 shall result in an equal dollar reduction in the Florida
26 Education Finance Program (FEFP) funds for the violating
27 district in the fiscal year following the audit citation.
