11  Senator Forman moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 57, between lines 24 and 25,

15

16  insert:

17         Section 49.  Subsection (1) of section 459.016, Florida

18  Statutes, is amended to read:

19         459.016  Reports of disciplinary actions by medical

20  organizations.--

21         (1)  The department shall be notified when any

22  osteopathic physician:

23         (a)  Has been removed or suspended or has had any other

24  disciplinary action taken by her or his peers within any

25  professional medical association, society, body, or

26  professional standards review organization established

27  pursuant to Pub. L. No. 92-603, s. 249F, or similarly

28  constituted professional organization, whether or not such

29  association, society, body, or organization is local,

30  regional, state, national, or international in scope; or

31         (b)  Has been disciplined, which shall include allowing

 1  an osteopathic physician to resign, by a licensed hospital or

 2  medical staff of said hospital for any act that constitutes a

 3  violation of this chapter.  If a physician resigns or

 4  withdraws from privileges when such facility notifies the

 5  physician that it is conducting an investigation or inquiry

 6  regarding an act which is potentially a violation of this

 7  chapter, the facility shall complete its investigation or

 8  inquiry and shall notify the department of the physician's

 9  resignation or withdrawal from privileges if the completed

10  investigation or inquiry results in a finding that such act

11  constitutes a violation of this chapter for which the facility

12  would have disciplined the physician or allowed her or him to

13  resign or withdraw from privileges.

15  Within 20 days of receipt of such notification, upon board

16  approval, the department shall notify all hospitals and health

17  maintenance organizations in the state of any disciplinary

18  action which is severe enough for expulsion or resignation

19  reported pursuant to this subsection, identifying the

20  disciplined physician, the action taken, and the reason for

21  such action.
