14 On page 2, between lines 26 and 27,

16 insert:
17 Section 2. Section 810.14, Florida Statutes, is
18 created to read:
19 810.14 Voyeurism prohibited; penalties.--
20 (1) A person commits the offense of voyeurism when he
21 or she, with lewd, lascivious, or indecent intent, secretly
22 observes, photographs, films, videotapes, or records another
23 person when such other person is located in a dwelling,
24 structure, or conveyance and such location provides a
25 reasonable expectation of privacy.
26 (2) A person may be convicted of and sentenced
27 separately for a violation of this section and for any other
28 criminal offense, including, but not limited to, burglary,
29 trespass, or loitering.
30 (3) A person who violates this section commits:
31 (a) A misdemeanor of the first degree for the first

1 violation, punishable as provided in s. 775.082 or s. 775.083.
2 (b) A felony of the third degree for a second or

10 And the title is amended as follows:
11 On page 1, lines 2 through 10, delete those lines

13 and insert:
14 An act relating to criminal justice; amending
15 s. 806.13, F.S.; authorizing the aggregation of
16 the value of damage to separate properties in
17 determining the grade of the offense for
18 criminal mischief in which the damage occurred
19 during one scheme or course of conduct;
20 creating s. 810.14, F.S.; prohibiting a person
21 from secretly observing or committing other
22 acts against another person with lewd,
23 lascivious, or indecent intent when the other
24 person is in a location that provides a
25 reasonable expectation of privacy; providing
26 that a person may be convicted and sentenced
27 separately for the voyeurism offense and for
28 any other criminal offense; providing for
29 criminal penalties; providing an effective
30 date.
