14 On page 2, between lines 26 and 27,

16 insert:
17 Section 3. Section 810.14, Florida Statutes, is
18 created to read:
19 810.14 Voyeurism prohibited; penalties.--
20 (1) A person commits the offense of voyeurism when he
21 or she, with lewd, lascivious, or indecent intent, secretly
22 observes, photographs, films, videotapes, or records another
23 person when such other person is located in a dwelling,
24 structure, or conveyance and such location provides a
25 reasonable expectation of privacy.
26 (2) A person who violates this section commits a
27 misdemeanor of the first degree for the first violation,
28 punishable as provided in s. 775.082, s. 775.083, or s.
29 775.084.
30 (3) A person who violates this section and who twice
31 has been convicted or adjudicated delinquent of any violation

1 of this section commits a felony of the third degree,
2 punishable as provided in s. 775.082, s. 775.083, or s.
3 775.084.
4 (4) For purposes of this section, a person has been
5 previously convicted or adjudicated delinquent of a violation
6 of this section if the violation resulted in a conviction
7 sentenced separately, or an adjudication of delinquency
8 entered separately, prior to the current offense.

22 person is in a location that provides a
23 reasonable expectation of privacy; providing
24 for criminal penalties; defining a previous
25 conviction or adjudication of delinquency;
