1 A bill to be entitled
2 An act relating to the Parole Commission;
3 amending s. 947.04, F.S.; providing for the
4 rate of pay for temporary duty on the
5 commission to be established each year in the
6 General Appropriations Act; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (1) of section 947.04, Florida
12 Statutes, is amended to read:
13 947.04 Organization of commission; officers;
14 offices.--
15 (1) Before July 1 of each even-numbered year, the
16 Governor and Cabinet shall select a chair who shall serve for
17 a period of 2 years and until a successor is selected and
18 qualified. The Governor and Cabinet shall, at the same time
19 that a chair is selected, select a vice chair to serve during
20 the same 2-year period as the chair, in the absence of the
21 chair. The chair may succeed himself or herself. The chair,
22 as chief administrative officer of the commission, has the
23 authority and responsibility to plan, direct, coordinate, and
24 execute the powers, duties, and responsibilities assigned to
25 the commission, except those of granting and revoking parole
26 as provided for in this chapter. Subject to approval by the
27 Governor and the Cabinet, the chair may assign consenting
28 retired commissioners or former commissioners to temporary
29 duty when there is a workload need. Any such commissioner
30 shall be paid $100 for each day or portion of a day spent on
31 the work of the commission and are entitled to reimbursement

1 shall be reimbursed for travel expenses as provided in s.
2 112.061. The amount paid to a commissioner for performing
3 temporary duty shall be established each year in the General
4 Appropriations Act. The chair may is authorized to provide or
5 disseminate information relative to parole by means of
6 documents, seminars, programs, or otherwise as he or she
7 determines necessary. The chair shall establish, execute, and
8 be held accountable for all administrative policy decisions.
9 However, decisions to grant or revoke parole shall be made in
10 accordance with the provisions of ss. 947.172, 947.174, and
11 947.23. The commissioners shall be directly accountable to the
12 chair in the execution of their duties as commissioners, and
13 the chair may has authority to recommend to the Governor
14 suspension of a commissioner who fails to perform the duties
15 provided for by statute.
16 Section 2. This act shall take effect upon becoming a
17 law.
