17 and insert:
18 Section 1. Subsection (2) of section 414.065, Florida
19 Statutes, 1996 Supplement, is amended, present subsections
20 (10) and (11) of that section are redesignated as subsections
21 (11) and (12), respectively, and a new subsection (10) is
22 added to that section, to read:
23 414.065 Work requirements.--
24 (2) WORK ACTIVITY REQUIREMENTS.--Each adult
25 participant who is not otherwise exempt must participate in a
26 work activity for the maximum number of hours allowable under
27 federal law provided that no participant be required to work
28 more than 40 hours per week or less than the minimum number of
29 hours required by federal law. The maximum number of hours
30 each month that a participant may be required to participate
31 in community service work experience is the greater number of

1 hours resulting from either of the following:
2 a. The result from dividing the family's monthly cash
3 assistance amount plus the value of food stamps received by
4 the family by the federal minimum wage, then dividing that
5 result by the number of participants in the family who
6 participate in community service work experience; or
7 b. The number of hours of community service work
8 experience which, when added to any other qualified work
9 activity, equals the minimum federal requirement. An applicant
10 shall be referred for employment at the time of application if
11 the applicant is eligible to participate in the WAGES Program.
12 (10) PROTECTION FOR CURRENT EMPLOYEES.--In
13 establishing and contracting for work experience and community
14 service activities, other work experience activities,
15 on-the-job training, subsidized employment, and work
16 supplementation under the WAGES Program, the following
17 conditions apply:
18 (a) A currently employed worker may not be displaced,
19 completely or partially; current conditions of a person's
20 employment may not be changed; and hours of non-overtime work,
21 wages, and benefits may not be reduced by a WAGES participant.
22 (b) Existing contracts for services and collective
23 bargaining agreements may not be impaired.
24 (c) A participant may not be assigned to an activity
25 or employed in a position if:
26 1. Another person is laid off from the same or a
27 substantially equivalent job within the same organizational
28 unit.
29 2. The position is vacant as a result of a strike,
30 lockout, or any other labor dispute.
31 3. An employer creates a vacancy or replaces an

1 existing employee in order to fill that position with a WAGES
2 participant.
3 4. The assignment or employment infringes in any way
4 upon promotional opportunities of any currently employed
5 individual.
