14 On page 3, between lines 3 and 4,

16 insert:
17 Section 2. Effective upon this act becoming a law,
18 subsection (9) of section 336.025, Florida Statutes, is
19 renumbered as subsection (10) and a new subsection (9) is
20 added to said section to read:
21 336.025 County transportation system; levy of local
22 option fuel tax on motor fuel and diesel fuel.--
23 (9) Notwithstanding any other provision of this
24 section, the governing board of a charter county that has a
25 population of 1,250,000 or more persons and which levied a
26 3-cent tax under paragraph (1)(b) prior to January 1, 1998,
27 may use the proceeds of 1 cent of that 3-cent tax in any
28 fiscal year to fund any homeless assistance program within the
29 county. The charter county may establish an interlocal
30 agreement with one or more municipalities located within the
31 county, representing a majority of the population of the

1 incorporated area in such county, which excludes the
2 distribution of any proceeds derived from the 1-cent tax that
3 is used for homeless assistance programs countywide. In
4 authorizing the use of these proceeds for countywide homeless
5 assistance programs, the governing body of the charter county
6 must adopt a resolution certifying that the charter county is
7 meeting its transportation needs as identified in the 5-year
8 transportation capital improvements program included within
9 the capital improvements element of such charter county's
10 comprehensive plan. The charter county shall file a certified
11 copy of such resolution with the executive director of the
12 Department of Revenue and the Secretary of Community Affairs.
13 For purposes of this subsection, "homeless assistance program"
14 includes, but is not limited to, the construction, renovation,
15 rehabilitation, and operation of emergency shelters, homeless
16 assistance centers, or other housing facilities which provide
17 assistance to homeless persons within the county. Unless
18 otherwise extended, the use of these proceeds for countywide
19 homeless assistance programs as authorized by this subsection
20 shall expire on September 30, 2003.
