  1                      A bill to be entitled

  2         An act relating to transportation

  3         administration; amending s. 338.223, F.S.;

  4         requiring a determination of environmental

  5         feasibility before the acquisition of

  6         right-of-way for a proposed turnpike project;

  7         providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Paragraph (b) of subsection (2) of section

12  338.223, Florida Statutes, is amended to read:

13         338.223  Proposed turnpike projects.--

14         (2)

15         (b)  In accordance with the legislative intent

16  expressed in s. 337.273, and after the requirements of

17  paragraph (1)(c) have been met, the department may acquire

18  lands and property before making a final determination of the

19  economic feasibility of a project. The cost of advance

20  acquisition of right-of-way may be paid from bonds issued

21  under s. 337.276 or from turnpike revenues.

22         Section 2.  This act shall take effect upon becoming a

23  law.
