  1                      A bill to be entitled

  2         An act relating to parole; amending s. 775.082,

  3         F.S.; providing that a defendant may not be

  4         granted parole from a sentence imposed for an

  5         offense committed on or after a specified date

  6         if a child or older adult was the victim of the

  7         offense or if the offense was part of any

  8         gang-related activity; providing an effective

  9         date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Present subsection (9) of section 775.082,

14  Florida Statutes, is redesignated as subsection (10), and a

15  new subsection (9) is added to that section, to read:

16         775.082  Penalties; mandatory minimum sentences for

17  certain reoffenders previously released from prison.--

18         (9)  Notwithstanding any other law, a defendant may not

19  be granted parole from a sentence imposed for any offense

20  committed on or after October 1, 1998, if:

21         (a)  The victim of the offense is a minor under 16

22  years of age or an adult 65 years of age or older.

23         (b)  The offense was part of any gang-related activity.

24         Section 2.  This act shall take effect October 1, 1998.

27                          SENATE SUMMARY

28    Provides that a defendant may not be granted parole from
      a sentence imposed for an offense committed on or after
29    October 1, 1998, if the victim of the offense is a child
      under 16 years of age or an adult 65 years of age or
30    older or if the offense was part of any gang-related
      activity.
