2 An act relating to the termination of
3 pregnancies; amending s. 390.0111, F.S.;
4 prohibiting a physician from performing a
5 partial-birth abortion; providing certain
6 limitations on prosecutions under such
7 prohibition; providing that the prohibition
8 does not apply if the procedure is necessary to
9 save the life of the mother; amending s.
10 390.011, F.S.; defining the term "partial-birth
11 abortion"; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Present subsections (8) and (9) of section
16 390.0111, Florida Statutes, are redesignated as subsections
17 (9) and (10), respectively, and a new subsection (8) is added
18 to that section, to read:
19 390.0111 Termination of pregnancies.--
20 (8) PARTIAL-BIRTH ABORTION PROHIBITED; EXCEPTION.--
21 (a) A physician may not knowingly perform a
22 partial-birth abortion.
23 (b) A woman upon whom a partial-birth abortion is
24 performed may not be prosecuted under this section for a
25 conspiracy to violate the provisions of this section.
26 (c) This subsection does not apply to a partial-birth
27 abortion that is necessary to save the life of a mother whose
28 life is endangered by a physical disorder, illness, or injury,
29 provided that no other medical procedure would suffice for
30 that purpose.

1 Section 2. Present subsections (6) and (7) of section
2 390.011, Florida Statutes, are redesignated as subsections (7)
3 and (8), respectively, and a new subsection (6) is added to
4 that section, to read:
5 390.011 Definitions.--As used in this chapter, the
6 term:
7 (5) "Partial-birth abortion" means a termination of
8 pregnancy in which the physician performing the termination of
9 pregnancy partially vaginally delivers a living fetus before
10 killing the fetus and completing the delivery.
11 Section 3. This act shall take effect upon becoming a
12 law.

15 SENATE SUMMARY
16 Prohibits a physician from performing a partial-birth
abortion. Provides that a woman may not be prosecuted for
17 conspiring to commit such a violation. Provides that the
prohibition does not apply if the procedure is necessary
18 to save the life of the mother.
