  1                      A bill to be entitled

  2         An act relating to the Florida Highway Patrol;

  3         amending s. 321.24, F.S.; deleting

  4         authorization for members of the highway-patrol

  5         auxiliary to make arrests; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Subsections (1) and (2) of section 321.24,

11  Florida Statutes, are amended to read:

12         321.24  Members of an auxiliary to Florida Highway

13  Patrol.--

14         (1)  The director of the Florida Highway Patrol is

15  hereby authorized to establish an auxiliary to the Florida

16  Highway Patrol to be composed of such persons who may

17  volunteer to serve as members of an auxiliary to the Florida

18  Highway Patrol. Such service is to be without compensation to

19  the individual so volunteering.

20         (2)  Members of an auxiliary serving with the Florida

21  Highway Patrol shall at all times serve under the direction

22  and supervision of the director and members of the Florida

23  Highway Patrol. After approval by the director on an

24  individual basis and after completion of a firearms course

25  approved by the director, members of an auxiliary, while

26  serving under the supervision and direction of the director,

27  or a member of the Florida Highway Patrol, shall have the

28  power to bear arms and make arrests. Members of an auxiliary

29  shall have the same protection and immunities afforded

30  regularly employed highway patrol officers, which shall be

  1  recognized by all courts having jurisdiction over offenses

  2  against the laws of this state.

  3         Section 2.  This act shall take effect July 1, 1998.

  7    Repeals the authority to make arrests from the powers of
      the Florida Highway Patrol auxiliary.
