1 A bill to be entitled
2 An act relating to the construction industry;
3 amending ss. 489.127, 489.531, F.S.;
4 authorizing a county or municipality to require
5 that a licensed journeyman in the plumbing and
6 pipefitting trade, the mechanical trade, the
7 HVAC trade, or the electrical trade be present
8 at any job site where work in the respective
9 trade is being performed; authorizing a county
10 or municipality to specify the ratio of
11 journeymen to apprentices and helpers required
12 at a job site; providing certain limitations;
13 providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Paragraph (n) of subsection (5) of section
18 489.127, Florida Statutes, is amended to read:
19 489.127 Prohibitions; penalties.--
20 (5) Each county or municipality may, at its option,
21 designate one or more of its code enforcement officers, as
22 defined in chapter 162, to enforce, as set out in this
23 subsection, the provisions of subsection (1) and s. 489.132(1)
24 against persons who engage in activity for which a county or
25 municipal certificate of competency or license or state
26 certification or registration is required.
27 (n) Nothing contained in This subsection does not
28 shall prohibit a county or municipality from enforcing its
29 codes or ordinances by any other means. A county or
30 municipality may require that a licensed journeyman in the
31 plumbing and pipefitting trade; the mechanical trade; or the

1 heating, ventilating, and air-conditioning trade be present at
2 each job site when work in the respective trade is being
3 performed for the purpose of supervising or performing the
4 work. In addition, the county or municipality may require that
5 the number of licensed journeymen present at the job site
6 equal a specified ratio of the number of apprentices and
7 helpers present at the job site. If such ratio is established,
8 the county or municipality may not require that more than one
9 journeyman be present at the job site for every 10 or fewer
10 apprentices and helpers present at the job site.
11 Section 2. Paragraph (n) of subsection (3) of section
12 489.531, Florida Statutes, is amended to read:
13 489.531 Prohibitions; penalties.--
14 (3) Each county or municipality may, at its option,

29 and helpers present at the job site. If such ratio is
30 established, the county or municipality may not require that
31 more than one licensed journeyman electrician be present at

1 the job site for every 10 or fewer apprentices and helpers
2 present at the job site.
3 Section 3. This act shall take effect July 1, 1998.

6 SENATE SUMMARY
7 Provides that a county or municipality may require a
licensed journeyman in the plumbing and pipefitting
8 trade; the mechanical trade; the heating, ventilating,
and air-conditioning trade; or the electrical trade to be
9 present at any job site where work in the respective
trade is being performed. Provides that the county or
10 municipality may specify a ratio of required journeymen
to apprentices and helpers. Provides that the ratio may
11 not require more than one journeyman to be present for
each 10 apprentices and helpers at the job site.
