  2         An act relating to education; amending s.

  3         24.121, F.S.; deleting obsolete language

  4         relating to the release of lottery funds to

  5         school districts; amending s. 229.58, F.S.;

  6         revising provisions relating to membership of

  7         school advisory councils; amending s. 229.591,

  8         F.S.; requiring postsecondary institutions to

  9         work toward the goal of ensuring professional

10         teachers and staff; amending s. 230.23, F.S.,

11         relating to school improvement and

12         accountability; requiring school board approval

13         of school improvement plans by August 15

14         annually; providing an effective date.

16  Be It Enacted by the Legislature of the State of Florida:

17

18         Section 1.  Paragraph (d) of subsection (5) of section

19  24.121, Florida Statutes, as amended by section 12 of chapter

20  97-384, Laws of Florida, is amended to read:

21         24.121  Allocation of revenues and expenditure of funds

22  for public education.--

24         (d)  Beginning July 1, 1993, No funds shall be released

25  for any purpose from the Educational Enhancement Trust Fund to

26  any school district in which one or more schools do not have

27  an approved school improvement plan pursuant to s. 230.23(16).

28         Section 2.  Paragraph (a) of subsection (1) of section

29  229.58, Florida Statutes, is amended to read:

30         229.58  District and school advisory councils.--

31         (1)  ESTABLISHMENT.--

  1         (a)  The school board shall establish an advisory

  2  council for each school in the district, and shall develop

  3  procedures for the election and appointment of advisory

  4  council members. A majority of the members of each school

  5  advisory council must be persons who are not employed by the

  6  school board. Each advisory council shall be composed of the

  7  principal and an appropriately balanced number of teachers,

  8  education support employees, students, parents, and other

  9  business and community citizens who are representative of the

10  ethnic, racial, and economic community served by the school.,

11  provided that Vocational-technical center and high school

12  advisory councils shall include students, and middle and

13  junior high school advisory councils may include students.

14  School advisory councils of vocational-technical and adult

15  education centers are not required to include parents as

16  members. Council members representing teachers, education

17  support employees, students, and parents shall be elected by

18  their respective peer groups at the school in a fair and

19  equitable manner as follows:

20         1.  Teachers shall be elected by teachers.

21         2.  Education support employees shall be elected by

22  education support employees.

23         3.  Students shall be elected by students.

24         4.  Parents shall be elected by parents.

26  The school board shall establish procedures for use by schools

27  in selecting business and community members. Such procedures

28  shall include means of ensuring wide notice of vacancies and

29  for taking input on possible members from local business,

30  chambers of commerce, community and civic organizations and

31  groups, and the public at large. The school board shall review

  1  the membership composition of each advisory council.  Should

  2  the school board determine that the membership elected by the

  3  school is not representative of the ethnic, racial, and

  4  economic community served by the school, the board shall

  5  appoint additional members to achieve proper representation.

  6  Although schools should be strongly encouraged to establish

  7  school advisory councils, any school district that has a

  8  student population of 10,000 or fewer may establish a district

  9  advisory council which shall include at least one duly elected

10  teacher from each school in the district.  For the purposes of

11  school advisory councils and district advisory councils, the

12  term "teacher" shall include classroom teachers, certified

13  student services personnel, and media specialists.  For

14  purposes of this paragraph, "education support employee" means

15  any person employed by a school who is not defined as

16  instructional or administrative personnel pursuant to s.

17  228.041 and whose duties require 20 or more hours in each

18  normal working week.

19         Section 3.  Paragraph (f) of subsection (3) of section

20  229.591, Florida Statutes, is amended to read:

21         229.591  Comprehensive revision of Florida's system of

22  school improvement and education accountability.--

23         (3)  EDUCATION GOALS.--The state as a whole shall work

24  toward the following goals:

25         (f)  Teachers and staff.--The schools, district, all

26  postsecondary institutions, and state ensure professional

27  teachers and staff.

28         Section 4.  Paragraph (a) of subsection (16) of section

29  230.23, Florida Statutes, is amended to read:

  1         230.23  Powers and duties of school board.--The school

  2  board, acting as a board, shall exercise all powers and

  3  perform all duties listed below:

  4         (16)  IMPLEMENT SCHOOL IMPROVEMENT AND

  5  ACCOUNTABILITY.--Maintain a system of school improvement and

  6  education accountability as provided by statute and State

  7  Board of Education rule. This system of school improvement and

  8  education accountability shall be consistent with, and

  9  implemented through, the district's continuing system of

10  planning and budgeting required by this section and ss.

11  229.555 and 237.041. This system of school improvement and

12  education accountability shall include, but not be limited to,

13  the following:

14         (a)  School improvement plans.--By August 15 annually,

15  approve and require implementation of a new, amended, or

16  continuation school improvement plan for each school in the

17  district.  Such plan shall be designed to achieve the state

18  education goals and student performance standards pursuant to

19  ss. 229.591(3) and 229.592.

20         Section 5.  This act shall take effect upon becoming a

21  law.

24                          SENATE SUMMARY

      Deletes obsolete language relating to the release of
26    lottery funds to school districts. Revises provisions
      relating to membership of school advisory councils by
27    providing that such councils need not include parents as
      members. Requires postsecondary institutions to work
28    toward the goal of ensuring professional teachers and
      staff in the schools of this state. Requires school
29    boards to approve school improvement plans annually by
      August 15.
