  1                      A bill to be entitled

  2         An act relating to education; amending s.

  3         24.121, F.S.; deleting obsolete language

  4         relating to the release of lottery funds to

  5         school districts; amending s. 229.58, F.S.;

  6         revising provisions relating to membership of

  7         school advisory councils; amending s. 229.591,

  8         F.S.; requiring postsecondary institutions to

  9         work toward the goal of ensuring professional

10         teachers and staff; providing an effective

11         date.

13  Be It Enacted by the Legislature of the State of Florida:

14

15         Section 1.  Paragraph (d) of subsection (5) of section

16  24.121, Florida Statutes, as amended by section 12 of chapter

17  97-384, Laws of Florida, is amended to read:

18         24.121  Allocation of revenues and expenditure of funds

19  for public education.--

20         (5)

21         (d)  Beginning July 1, 1993, No funds shall be released

22  for any purpose from the Educational Enhancement Trust Fund to

23  any school district in which one or more schools do not have

24  an approved school improvement plan pursuant to s. 230.23(16).

25         Section 2.  Paragraph (a) of subsection (1) of section

26  229.58, Florida Statutes, is amended to read:

27         229.58  District and school advisory councils.--

28         (1)  ESTABLISHMENT.--

29         (a)  The school board shall establish an advisory

30  council for each school in the district, and shall develop

31  procedures for the election and appointment of advisory

  1  council members. A majority of the members of each school

  2  advisory council must be persons who are not employed by the

  3  school board. Each advisory council shall be composed of the

  4  principal and an appropriately balanced number of teachers,

  5  education support employees, students, parents, and other

  6  business and community citizens who are representative of the

  7  ethnic, racial, and economic community served by the school.,

  8  provided that Vocational-technical center and high school

  9  advisory councils shall include students, and middle and

10  junior high school advisory councils may include students.

11  School advisory councils of vocational-technical and adult

12  education centers are not required to include parents as

13  members. Council members representing teachers, education

14  support employees, students, and parents shall be elected by

15  their respective peer groups at the school in a fair and

16  equitable manner as follows:

17         1.  Teachers shall be elected by teachers.

18         2.  Education support employees shall be elected by

19  education support employees.

20         3.  Students shall be elected by students.

21         4.  Parents shall be elected by parents.

23  The school board shall establish procedures for use by schools

24  in selecting business and community members. Such procedures

25  shall include means of ensuring wide notice of vacancies and

26  for taking input on possible members from local business,

27  chambers of commerce, community and civic organizations and

28  groups, and the public at large. The school board shall review

29  the membership composition of each advisory council.  Should

30  the school board determine that the membership elected by the

31  school is not representative of the ethnic, racial, and

  1  economic community served by the school, the board shall

  2  appoint additional members to achieve proper representation.

  3  Although schools should be strongly encouraged to establish

  4  school advisory councils, any school district that has a

  5  student population of 10,000 or fewer may establish a district

  6  advisory council which shall include at least one duly elected

  7  teacher from each school in the district.  For the purposes of

  8  school advisory councils and district advisory councils, the

  9  term "teacher" shall include classroom teachers, certified

10  student services personnel, and media specialists.  For

11  purposes of this paragraph, "education support employee" means

12  any person employed by a school who is not defined as

13  instructional or administrative personnel pursuant to s.

14  228.041 and whose duties require 20 or more hours in each

15  normal working week.

16         Section 3.  Paragraph (f) of subsection (3) of section

17  229.591, Florida Statutes, is amended to read:

18         229.591  Comprehensive revision of Florida's system of

19  school improvement and education accountability.--

20         (3)  EDUCATION GOALS.--The state as a whole shall work

21  toward the following goals:

22         (f)  Teachers and staff.--The schools, district, all

23  postsecondary institutions, and state ensure professional

24  teachers and staff.

25         Section 4.  This act shall take effect upon becoming a

26  law.

                       COMMITTEE SUBSTITUTE FOR

  4  The committee substitute does not change the requirement that
    a majority of the members of a school advisory council be
  5  persons who are not employed by the school board, and it does
    not provide a date by which school boards must approve school
  6  improvement plans.
