14 On page 59, lines 1-27, delete those lines
15
16 and insert: 6. Evaluate each program operated by the
17 department or a provider under a contract with the department
18 and establish minimum thresholds for each program component.
19 If a provider fails to meet the established minimum
20 thresholds, such failure shall cause the department to cancel
21 the provider's contract unless the provider achieves
22 compliance with minimum thresholds within 6 months or unless
23 there are documented extenuating circumstances. In addition,
24 the department may not contract with the same provider for the
25 canceled service for a period of 12 months. If a
26 department-operated program fails to meet the established
27 minimum thresholds, the department must take necessary and
28 sufficient steps to ensure and document program changes to
29 achieve compliance with the established minimum thresholds. If
30 the department-operated program fails to achieve compliance
31 with the established minimum thresholds within 6 months and if

1 there are no documented extenuating circumstances, the
2 department must notify the Executive Office of the Governor
3 and the Legislature of the corrective action taken.
4 Appropriate corrective action may include, but is not limited
5 to:
6 a. Contracting out for the services provided in the
7 program;
8 b. Initiating appropriate disciplinary action against
9 all employees whose conduct or performance is deemed to have
10 materially contributed to the program's failure to meet
11 established minimum thresholds;
12 c. Redesigning the program; or
13 d. Realigning the program.

15 The department shall submit an annual report to the President
16 of the Senate, the Speaker of the House of Representatives,
17 the Minority Leader of each house of the Legislature, the
18 appropriate substantive and fiscal committees of each house of
19 the Legislature, and the Governor, no later than February 1 of
20 each year. The annual report must contain, at a minimum, for
21 each specific program component: a comprehensive description
22 of the population served by the program; a specific
23 description of the services provided by the program; cost; a
24 comparison of expenditures to federal and state funding;
25 immediate and long-range concerns; and recommendations to
26 maintain, expand, improve, modify, or eliminate each program
27 component so that changes in services lead to enhancement in
28 program quality. The department department's inspector general
29 shall ensure the reliability and validity of the information
30 contained in the report.
