  1                      A bill to be entitled

  2         An act relating to illegal aliens; amending s.

  3         287.012, F.S.; providing that, to be a

  4         "qualified bidder" with respect to providing

  5         personal property or services, a person must

  6         certify that he does not, and will not, employ

  7         illegal aliens, as defined; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (13) of section 287.012, Florida

13  Statutes, 1996 Supplement, is amended, and subsection (20) is

14  added to that section, to read:

15         287.012  Definitions.--The following definitions shall

16  apply in this part:

17         (13)  "Qualified bidder," "responsible bidder,"

18  "qualified offeror," or "responsible offeror" means a person

19  who has the capability in all respects to perform fully the

20  contract requirements, certifies under oath that illegal

21  aliens are not and will not be employed by that person, and

22  has the integrity and reliability which will assure good faith

23  performance.

24         (20)  "Illegal alien" means a person who is in the

25  state in violation of immigration laws and the Constitution of

26  the United States.

27         Section 2.  This act shall take effect October 1, 1997.

  2                          SENATE SUMMARY

  3    Defines the term "illegal alien" to mean a person who is
      in the state in violation of immigration laws and the
  4    U.S. Constitution and provides that, to be a "qualified
      bidder" or a synonymous term for purposes of providing
  5    personal property or services to a governmental agency, a
      person must certify that he does not, and will not,
  6    employ illegal aliens.
