11  The Committee on Ways and Means recommended the following

12  amendment:

14         Senate Amendment 

15         On page 1, between lines 23 and 24,

17  insert:

18         (4)  This bill shall apply only to state funds expended

19  to pay attorney's fees and does not apply to, nor limit, such

20  fees determined payable by the tobacco companies in excess of

21  those funds payable to the state pursuant to the settlement

22  agreement.

23         (5)  This bill shall not be construed as an

24  appropriation of funds which have not been received.
