2 An act relating to state lands; amending s.
3 253.03, F.S.; authorizing the Board of Trustees
4 of the Internal Improvement Trust Fund to enter
5 special-event agreements for the use of
6 submerged lands for events that meet specified
7 criteria; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Paragraph (d) is added to subsection (7) of
12 section 253.03, Florida Statutes, to read:
13 253.03 Board of trustees to administer state lands;
14 lands enumerated.--

16 (d) The Board of Trustees of the Internal Improvement
17 Trust Fund may authorize the use of submerged lands for a
18 special event such as, but not limited to, a boat show under a
19 special-event agreement if the event:
20 1. Generates or is intended to generate revenue or
21 income;
22 2. Requires the temporary installation of structures
23 such as, but not limited to, docks, mooring pilings, and
24 access walkways;
25 3. Customarily occurs at a specific site for a period
26 of more than 24 hours but less than 60 days; and
27 4. Customarily recurs on a regular basis.

29 It is the intent of the Legislature that an applicant for a
30 special-event agreement under this paragraph need not be an
31 adjacent riparian landowner. The board shall determine the

1 merits of any objection or refusal to consent by an adjacent
2 riparian landowner, and it shall balance the rights of those
3 landowners with the economic interests of the public and the
4 state.
5 Section 2. This act shall take effect upon becoming a
6 law.

9 SENATE SUMMARY
10 Authorizes the Board of Trustees of the Internal
Improvement Trust Fund to enter agreements for the use of
11 submerged state lands for special events that are or are
intended to be income producing; that require the
12 installation of some temporary structure; that last from
24 hours to 60 days; and that recur regularly.
