  1                      A bill to be entitled

  2         An act relating to the Florida Safety Belt Law;

  3         amending s. 316.614, F.S.; deleting a provision

  4         that requires enforcement of the act only as a

  5         secondary action; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Subsection (8) of section 316.614, Florida

10  Statutes, is amended to read:

11         316.614  Safety belt usage.--

12         (8)  Any person who violates the provisions of this

13  section commits a nonmoving violation, punishable as provided

14  in chapter 318. However, enforcement of this section by state

15  or local law enforcement agencies must be accomplished only as

16  a secondary action when a driver of a motor vehicle has been

17  detained for a suspected violation of another section of this

18  chapter, chapter 320, or chapter 322.

19         Section 2.  This act shall take effect July 1, 1998.
