17 Section 1. (1) Each person who, as of July 2, 1998,
18 is registered to vote in the State of Florida under the
19 provisions of chapter 97, Florida Statutes, is entitled to a
20 distribution of $25 as set forth in this section.
21 (2) By August 17, 1998, every supervisor of elections
22 must provide to the Department of Revenue a certified list of
23 all voters registered in his or her county as of July 2, 1998.
24 This list must include each voter's name and the address and
25 must be in compatible electronic format. Distributions shall
26 be sent to qualified persons as soon as practicable, but no
27 later than November 1, 1998. Each check distributed shall
28 include a letter stating that the distribution is being
29 provided to registered voters by the Governor, the Cabinet,
30 and the Florida Legislature.
31 (3) If a delinquent child-support obligor is entitled

1 to receive a distribution, the department must withhold the
2 amount of the delinquency from the rebate of that obligor. The
3 department shall notify the obligor that his or her rebate is
4 being withheld under this section for the purpose of paying
5 the obligor's delinquent child-support obligations. The
6 department shall apply the distribution amount withheld to the
7 delinquent child-support obligation and transmit the balance,
8 if any to the delinquent obligor.
9 (4) The department shall offset any distribution
10 pursuant to section 213.25, Florida Statutes, and any other
11 applicable law regarding debts or obligations owed to the
12 state.
13 (5) Under procedures established by the department,
14 each recipient of the distribution described in this section
15 may elect to return the distribution and designate the
16 application of the $25 to the state for one of the following
17 uses:
18 (a) Education;
19 (b) Children's health care;
20 (c) Criminal justice; or
21 (d) Transportation.
22 Section 2. The sum of $184 million is appropriated
23 from the General Revenue Fund to the Department of Revenue for
24 fiscal year 1998-1999 for distribution to eligible registered
25 voters. In the event these funds are insufficient to carry out
26 the provisions of this act, the Administration Commission is
27 authorized to transfer sufficient funds from the Working
28 Capital Fund.
29 Section 3. The sum of $1.8 million is appropriated
30 from the General Revenue Fund to the Department of Revenue for
31 fiscal year 1998-1999 to administer the distributions provided

1 for in this act. The department may contract with private
2 vendors to carry out the distributions, notwithstanding the
3 requirements set out in chapter 287, Florida Statutes. The
4 provisions of chapter 120, Florida Statutes, do not apply to
5 this act.
6 Section 4. Any action to challenge the validity or
7 constitutionality of the rebate provided for in this act must
8 be brought within 60 days after the effective date of this
9 act, or else the challenge is barred. If any such proceeding
10 is initiated, distribution of the rebate amounts under this
11 act shall be held in abeyance until a judicial determination
12 has become final and the time limit for any further proceeding
13 regarding the validity or constitutionality of this act has
14 expired.
15 Section 5. This act shall take effect upon becoming a
16 law.
