14         On page 13, lines 6-10, delete those lines

16  and insert:

17         (e) Availability standard.--Consistent with the public

18  welfare, a local government may not deny a development permit

19  authorizing residential development for failure to achieve and

20  maintain the level of service standard for public school

21  capacity in a local-option school concurrency system where

22  adequate school facilities will be in place or under actual

23  construction within 3 years after permit issuance.
