Florida House of Representatives - 1997 HB 249 By Representative Fasano 1 A bill to be entitled 2 An act relating to drawings by chance; amending 3 s. 849.0935, F.S.; providing additional 4 tax-exempt organizations which are authorized 5 to conduct drawings by chance under said 6 section, including civic organizations, 7 employees' associations, clubs, fraternal 8 benefit societies, and armed forces and 9 veterans' organizations; providing an effective 10 date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Paragraph (b) of subsection (1) and 15 subsection (2) of section 849.0935, Florida Statutes, 1996 16 Supplement, are amended to read: 17 849.0935 Charitable, nonprofit organizations; drawings 18 by chance; required disclosures; unlawful acts and practices; 19 penalties.-- 20 (1) As used in this section, the term: 21 (b) "Organization" means an organization which is 22 exempt from federal income taxation pursuant to 26 U.S.C. s. 23 501(c)(3), (4), (7), (8), or (19), and which has a current 24 determination letter from the Internal Revenue Service, and 25 its bona fide members or officers. 26 (2) The provisions of s. 849.09 shall not be construed 27 to prohibit an organization qualified under 26 U.S.C. s. 28 501(c)(3), (4), (7), (8), or (19) from conducting drawings by 29 chance pursuant to the authority granted by this section, 30 provided the organization has complied with all applicable 31 provisions of chapter 496. 1 CODING: Words stricken are deletions; words underlined are additions.
