16 insert: Section 1.
17 768.19 Right of action.--When the death of a person is
18 caused by the wrongful act, negligence, default, or breach of
19 contract or warranty of any person, including those occurring
20 on navigable waters, and the event would have entitled the
21 person injured to maintain an action and recover damages if
22 death had not ensued, the person or watercraft that would have
23 been liable in damages if death had not ensued shall be liable
24 for damages as specified in this act notwithstanding the death
25 of the person injured, although death was caused under
26 circumstances constituting a felony. Chapter 766 shall apply
27 to all wrongful death actions pursuant to s. 768.16-768.27
28 with respect to claims for medical malpractice as defined by
29 s. 766.106(1). Renumber subsequent sections.
