2 An act relating to casualty insurance; creating
3 s. 624.5094, F.S.; specifying application of
4 certain dividends or premium refunds for
5 certain purposes; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Section 624.5094, Florida Statutes, is
10 created to read:
11 624.5094 Casualty insurance premiums.--Notwithstanding
12 any other provision of law, for purposes of calculating annual
13 assessments for the Special Disability Trust Fund under s.
14 440.49, and expenses of administration under s. 440.51, any
15 amounts paid or credited by an insurer to policyholders as
16 dividends or premium refunds in a calendar year shall be
17 deducted from "net premium," "net premium written," "direct
18 premium," and "net premium collected" for such calendar year.
19 Such amounts paid or credited during the current year shall be
20 applied against the current year's net premium for the current
21 year's assessment regardless of the policy year for which the
22 dividends or premium refunds are being reimbursed.
23 Section 2. This act shall take effect upon becoming a
24 law.
