  1                      A bill to be entitled

  2         An act relating to employment by amusement

  3         enterprises; requiring an applicant for such

  4         employment to submit a set of fingerprints to

  5         the Department of Agriculture and Consumer

  6         Services; requiring the applicant to bear the

  7         costs of processing the fingerprints; providing

  8         that the work privilege is revocable by the

  9         department; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Each applicant for employment, including

14  those under lease agreement, with any traveling show,

15  exhibition, amusement enterprise, carnival, vaudeville,

16  minstrel, rodeo, theatrical enterprise, game or test of skill,

17  riding device, dramatic repertory, or other show or amusement

18  (including a concession operating in a tent, enclosure, or

19  other temporary structure, whether covered or uncovered)

20  within the grounds of, and in connection with, any public

21  fair, exposition, or amusement attraction must file a set of

22  his or her fingerprints with the Department of Agriculture and

23  Consumer Services for the purpose of determining any prior

24  criminal record. The department shall submit the fingerprints

25  to the Department of Law Enforcement for state processing and

26  forwarding to the Federal Bureau of Investigation for federal

27  processing. The applicant shall bear the actual cost of such

28  state and federal processing. The department may allow an

29  applicant to work pending the results of the fingerprint

30  investigation, which work privilege is fully revocable if the

  1  department subsequently determines that any facts set forth in

  2  the application are untrue or misrepresented.

  3         Section 2.  This act shall take effect July 1, 1998.

  7    Requires applicants for employment by specified amusement
