2 An act relating to Hillsborough County;
3 relating to the regulation of providers that
4 transport transportation disadvantaged clients
5 under a contract with the community
6 transportation coordinator; providing that the
7 notice of award of a contract between the
8 community transportation coordinator and a
9 transportation provider establishes public
10 convenience and necessity as required for
11 obtaining a certificate of public convenience
12 and necessity; authorizing the community
13 transportation coordinator to exempt certain
14 transportation providers from obtaining a
15 certificate of public convenience and necessity
16 from the Hillsborough County Public
17 Transportation Commission when specified
18 conditions have been met; providing an
19 effective date.

21 Be It Enacted by the Legislature of the State of Florida:
22
23 Section 1. (1) If a transportation provider applies
24 to the Hillsborough County Public Transportation Commission
25 for a certificate of public convenience and necessity
26 restricted exclusively to transporting clients in accordance
27 with a contract with the community transportation coordinator
28 created by chapter 427, Florida Statutes, and the applicant
29 provides the commission with a notice of award of the
30 contract, the notice of award establishes public necessity and
31 convenience as required for granting a certificate of public

1 convenience and necessity restricted to transporting clients
2 in accordance with the contract between the provider and the
3 community transportation coordinator as set forth in the
4 award, together with the number of vehicle permits which is
5 required under the contract. The restricted certificate is
6 renewable in accordance with the terms of the related contract
7 with the coordinator. All other provisions of the governing
8 statute and rules of the commission continue to apply.
9 (2) A public entity that is serving as the community
10 transportation coordinator may exempt providers that transport
11 clients in accordance with a contract between the provider and
12 the coordinator from subsection (1) if:
13 (a) The exemption applies to all providers that are
14 contracting with the coordinator;
15 (b) The exemption is limited to transportation
16 services provided under the contract; and
17 (c) The coordinator has otherwise provided for
18 inspecting the vehicles used to transport clients and
19 monitoring the safety of those vehicles and for reviewing and
20 monitoring the qualifications and safety of the drivers of
21 those vehicles.
22 Section 2. This act shall take effect upon becoming a
23 law.
