1 A bill to be entitled
2 An act relating to the City of Sunrise, Broward
3 County; creating the South Broward Utility
4 Advisory Board; providing for membership,
5 qualifications, terms, responsibilities, and
6 powers of the board; providing an
7 appropriation; providing a limitation of the
8 power of the board; providing for adoption of
9 procedures and regulations; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. There is hereby created the South Broward
15 Utility Advisory Board, which shall be an advisory board of
16 the City of Sunrise. The board shall be composed of seven
17 members, as follows: two members shall be appointed by the
18 City of Sunrise, two members shall be appointed by the Town of
19 Davie, one member shall be appointed by the City of Pembroke
20 Pines, and two members shall be appointed by the Broward
21 County Commission. Each appointed member shall be a water and
22 sewer user within the service area of the former South Broward
23 Utility. Terms of each member shall be for 2 years, except
24 that all appointments and retention of board members shall be
25 at the sole discretion of the appointing authorities.
26 (1) The responsibility of the board shall be to review
27 and advise the City of Sunrise regarding any proposed change
28 by the city to the water and sewer rates charged within the
29 area which was formerly the South Broward Utility service
30 area. In the event of a proposed rate change within such area,
31 the South Broward Utility Advisory Board may require the City

1 of Sunrise to hire a rate consultant to advise the city
2 regarding such proposed rate change.
3 (2) Within 30 days following notice of a rate change,
4 the advisory board shall present a report of its findings to
5 the Commission of the City of Sunrise. If presented within the
6 30-day period, the report shall be considered by the
7 commission before rates may be altered or changed within the
8 area formerly served by the South Broward Utility.
9 (3) The City of Sunrise shall appropriate not more
10 than $25,000 annually for a rate consultant for the South
11 Broward Utility Advisory Board, as provided in subsection (1).
12 (4) The advisory board shall have no legal standing to
13 bring any legal action.
14 (5) The City of Sunrise shall, by ordinance, provide
15 for such other procedures and regulations which are not in
16 conflict with this act as are necessary for the continued
17 operation of the board.
18 Section 2. This act shall take effect upon becoming a
19 law.
