  1                      A bill to be entitled

  2         An act relating to the Town of Davie, Broward

  3         County; extending and enlarging the corporate

  4         limits of the Town of Davie to include

  5         specified unincorporated lands within said

  6         corporate limits; redefining the town limits;

  7         providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  The present corporate limits of the Town of

12  Davie, Broward County, Florida, are hereby extended and

13  enlarged so as to include, in addition to the territory

14  presently within its corporate limits, the area particularly

15  described as follows:

17         DESCRIPTION: (KING'S MANOR)

18

19         A PORTION  OF "GROLIER VILLAGE" AS RECORDED IN

20         PLAT BOOK 71, PAGE 4 OF THE PUBLIC RECORDS OF

21         BROWARD COUNTY, FLORIDA, TOGETHER WITH A

22         PORTION OF "KINGS MANOR ESTATES WEST", AS

23         RECORDED IN PLAT BOOK 75, PAGE 6 OF THE PUBLIC

24         RECORDS OF BROWARD COUNTY, FLORIDA, ALL BEING

25         MORE PARTICULARLY DESCRIBED AS FOLLOWS:

27         COMMENCE AT THE NORTHEAST CORNER OF SECTION 11,

28         TOWNSHIP 50 SOUTH, RANGE 40 EAST; THENCE

29         SOUTHERLY ALONG THE EAST LINE OF SAID SECTION

30         11 TO A POINT OF INTERSECTION WITH THE EASTERLY

31         EXTENSION OF THE NORTH LINE OF TRACT A OF

  1         "ARBORETUM" ACCORDING TO THE PLAT THEREOF AS

  2         RECORDED IN PLAT BOOK 148, PAGE 22 OF THE

  3         PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA;

  4         THENCE WESTERLY ALONG SAID EXTENSION TO THE

  5         WEST RIGHT-OF-WAY LINE OF FLAMINGO ROAD AND THE

  6         POINT OF BEGINNING; THENCE CONTINUE WESTERLY

  7         ALONG SAID NORTH LINE TO THE NORTHWEST CORNER

  8         OF LOT 13 OF SAID "ARBORETUM", THENCE NORTHERLY

  9         ALONG THE WEST LINE OF SAID "GROLIER VILLAGE"

10         AND SAID "KINGS MANOR ESTATES WEST" TO THE

11         NORTHWEST CORNER OF SAID "KINGS MANOR ESTATES

12         WEST"; THENCE EASTERLY ALONG THE NORTHERLY LINE

13         OF SAID "KINGS MANOR ESTATES WEST" TO A POINT

14         OF INTERSECTION WITH THE SOUTHERLY RIGHT-OF-WAY

15         LINE OF STATE ROAD 84; THENCE SOUTHEASTERLY

16         ALONG SAID SOUTHERLY RIGHT-OF-WAY LINE TO A

17         POINT OF INTERSECTION WITH THE WESTERLY

18         RIGHT-OF-WAY LINE OF FLAMINGO ROAD; THENCE

19         SOUTHERLY ALONG SAID WESTERLY RIGHT-OF-WAY LINE

20         TO THE POINT OF BEGINNING.

22         SAID LANDS SITUATE, LYING AND BEING IN BROWARD

23         COUNTY, FLORIDA. AND CONTAINING 44.5 ACRES,

24         MORE OR LESS.

25         Section 2.  On the effective date of this act, the Town

26  of Davie shall be responsible for and embodied with all

27  municipal powers granted in chapter 166, Florida Statutes,

28  over the territory hereby annexed.

29         Section 3.  Nothing in this act shall be construed to

30  affect or abrogate the rights of parties to any contracts,

31  whether the same be between Broward County and a third party

  1  or between nongovernmental entities, which contracts are in

  2  effect prior to the effective date of annexation.

  3         Section 4.  Notwithstanding the provisions of section

  4  335.0415, Florida Statutes, all public roads and the public

  5  rights of way associated therewith, lying within the limits of

  6  the lands subject to annexation herein, as described in

  7  section 1, are transferred from Broward County jurisdiction to

  8  the jurisdiction of the annexing municipality. All rights,

  9  title, interests, and responsibilities for any transferred

10  roads, including, but not limited to, the operation,

11  maintenance, planning, design, and construction of said roads,

12  and the rights of way associated therewith, shall transfer

13  from Broward County jurisdiction to the jurisdiction of the

14  annexing municipality upon the effective date of this act.

15         Section 5.  This act shall take effect October 1, 1998.
