  1                      A bill to be entitled

  2         An act relating to Broward County; providing

  3         for notice of water or sewer rate changes to

  4         residents served outside of municipal

  5         boundaries within Broward County; providing for

  6         a public hearing; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Notwithstanding the provisions of s.

11  180.191, Florida Statutes, any municipality within Broward

12  County which serves residents outside its corporate boundary

13  shall not change, alter, or amend any water or sewer rate

14  within such area without holding a public hearing duly noticed

15  by providing a notice in the bills of all customers outside

16  such municipality regarding the proposed change or alteration

17  to the water or sewer rates within such area. At said hearing,

18  the municipality providing the utility service shall explain

19  the necessity of the proposed rate change and demonstrate that

20  the rate is just and equitable.

21         Section 2.  This act shall take effect upon becoming a

22  law.
