  1                      A bill to be entitled

  2         An act relating to the Town of Davie, Broward

  3         County; extending and enlarging the corporate

  4         limits of the Town of Davie to include

  5         specified unincorporated lands within said

  6         corporate limits; redefining the town limits;

  7         providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  The present corporate limits of the Town of

12  Davie, Broward County, Florida, are hereby extended and

13  enlarged so as to include, in addition to the territory

14  presently within its corporate limits, the area particularly

15  described as follows:

13         COMMENCE AT THE NORTHWEST CORNER OF SECTION 16,

14         TOWNSHIP 50 SOUTH, RANGE 41 EAST; THENCE

15         SOUTHERLY ALONG THE WEST LINE OF SAID SECTION

16         16 TO A POINT OF INTERSECTION WITH THE WESTERLY

17         PROJECTION OF THE SOUTHERLY RIGHT-OF-WAY LINE

18         OF BERKLEY DRIVE; THENCE SOUTHEASTERLY ALONG

19         SAID WESTERLY PROJECTION TO A POINT OF

20         INTERSECTION WITH THE EASTERLY RIGHT-OF-WAY

21         LINE OF PINE ISLAND ROAD AND THE POINT OF

22         BEGINNING; THENCE CONTINUING ALONG SAID

23         SOUTHERLY RIGHT-OF-WAY LINE TO A POINT OF

24         INTERSECTION WITH THE EASTERLY LINE OF BLOCK 12

25         OF SAID "PARK CITY SECTION THREE"; THENCE

26         SOUTHERLY ALONG THE EASTERLY LINE OF SAID BLOCK

27         12 AND THE EASTERLY LINE OF SAID "PARK CITY

28         SECTION THREE 'A'" AND THE EASTERLY LINE OF

  1         NORTHWESTERLY ALONG THE SOUTHERLY LINE OF SAID

  2         LOT 36 TO A POINT OF INTERSECTION WITH THE

  3         SOUTHERLY RIGHT-OF-WAY LINE OF SOUTHWEST 23RD

  4         PLACE; THENCE SOUTHWESTERLY AND WESTERLY ALONG

  5         SAID SOUTHERLY RIGHT-OF-WAY LINE TO THE

  6         NORTHEAST CORNER OF LOT 2, BLOCK 4 OF SAID

  7         "PARK CITY SECTION THREE 'B'"; THENCE SOUTHERLY

  8         ALONG THE EASTERLY LINE OF SAID BLOCK 4 TO A

  9         POINT OF INTERSECTION WITH THE NORTHERLY

10         RIGHT-OF-WAY LINE OF SOUTHWEST 24TH STREET;

11         THENCE WESTERLY ALONG SAID NORTHERLY

12         RIGHT-OF-WAY LINE TO A POINT OF INTERSECTION

13         WITH THE EASTERLY RIGHT-OF-WAY LINE OF PINE

14         ISLAND ROAD; THENCE NORTHERLY ALONG SAID

15         EASTERLY RIGHT-OF-WAY LINE TO THE POINT OF

16         BEGINNING.

18         SAID LANDS SITUATE, LYING AND BEING IN BROWARD

19         COUNTY, FLORIDA, AND CONTAINING 172.5 ACRES,

20         MORE OR LESS.

21         Section 2.  On the effective date of this act, the Town

22  of Davie shall be responsible for and embodied with all

23  municipal powers granted in chapter 166, Florida Statutes,

24  over territory hereby annexed.

25         Section 3.  Nothing in this act shall be construed to

26  affect or abrogate the rights of parties to any contracts,

27  whether the same be between Broward County and a third party

28  or between nongovernmental entities, which contracts are in

29  effect prior to the effective date of annexation.

30         Section 4.  Notwithstanding the provisions of section

31  335.0415, Florida Statutes, all public roads and the public

  1  rights of way associated therewith, lying within the limits of

  2  the lands subject to annexation herein, as described in

  3  section 1, are transferred from Broward County jurisdiction to

  4  the jurisdiction of the annexing municipality. All rights,

  5  title, interests, and responsibilities for any transferred

  6  roads, including, but not limited to, the operation,

  7  maintenance, planning, design, and construction of said roads,

  8  and the rights of way associated therewith shall transfer from

  9  Broward County jurisdiction to the jurisdiction of the

10  annexing municipality upon the effective date of this act.

11         Section 5.  This act shall take effect October 1, 1998.
